Physician Tries to Report Child Sex Scandal at Clinic in Texas – Get’s Fired

This is a video from the Texas Medical Association with an interview of a physician wanting to report a case to the authorities she deemed necessary from her visits with the children, but when discussed with management, she was relieved of her job.  Do organizations listen to doctors or do they know better?  In the age of transparency we live in today, there’s not much to hide, so you can watch the video and make your own conclusion. 

If children are being abused and a clear case has been determined, why did they not listen?  Last month at a hospital in Texas, the ER staff was fired in what appears to be a catch 22 situation with admission being down, ER staff was told to admit more, then were fired for admitting those who who should not have been.  Video at the link below.  BD

Jay Leno in the hospital over the weekend for observation – misses his first show taping, ever

There’s no report on what Jay experienced, so maybe later we might have some additional details and perhaps when he returns, as expected on imageMonday he might even enlighten us himself.  BD

Late-night funnyman Jay Leno has checked himself into a hospital with a mystery illness - and Thursday night and Friday's "Tonight Show" tapings were canceled.

Leno, 58, wasn't feeling well, NBC spokeswoman Tracy St. Pierre said, but she was quick to shoot down Internet chatter that he had had a heart attack.

"No! My gosh!" St. Pierre said. "He's doing fine... He was kidding around with the hospital staff and running his monologue jokes by the doctors and the nurses. He's expected back to work on Monday.

"This is first time he's missed a show - period!"

Slow Down Diabetes By Eating Nuts – So Let’s Make some Available without Salmonella

I thought this study was very relevant to the recent tainted peanut case that has been all over the news and FDA for the last number of months.  If eating nuts is a food that can help with controlling diabetes, well let’s get with it and make sure they are not tainted.  image

On the blog, I keep the widget that shows the latest food recalls from the FDA.  The latest efforts from the FDA is to outsource the inspections to state authorities. 

Kroger has used some technology to keep the potentially contaminated products out of the hands of consumers, so could we perhaps see something along these lines with the FDA in the way of some business Intelligence software to help police the reporting and compliance end?  Enforcement agencies need software to help them do their job, and alerts ahead of time for potential issues before they go to the market place for the consumer.  I have mentioned this quite a bit in past posts with a bank of servers that would collect batch information and report in, and then the FDA as well as the factory has the numbers, before anything is shipped.  It needs to be done electronically as humans can only be in so many places at one time.  BD

If you have heard about “good fats” such as poly-unsaturated fats and omega fatty acids, found in fish and olive oil, then you know that researchers and nutrition professionals agree that these fats should replace the “bad fats” including trans fats and saturated fats found in junk food.

Another tool in this arsenal is surprisingly common: nuts. That’s right; you can munch your way to a lower glycemic index and control diabetes all while snacking on some peanuts.

Study findings showed that the group given the supplement with all mixed nuts had a significantly reduced LDL (bad cholesterol) and total cholesterol levels compared to the full dose muffin group. Additionally, there was also a significant reduction in HbA1c levels in participants with full dose mixed nut supplement than the other two diets. This indicates a greater glycemic control and higher degree of effectively managing diabetes.

Freddie Mac – Executive had been discussing taking time off – Stress Related Suicide?

The former CEO who stepped down last month will be returning to help out.  Freddie Mac, in view of what has occurred in today’s economy more than likely was a pretty stressful work place.  With all the financial algorithms and the fall of Wall Street and trying to rectify and turn the scenario around, if that can be accomplished could at minimum lead anyone to have sleepless nights.  imageI have issues related to some of the work I do with security and healthcare that keep me aware a night, of course perhaps minimal compared to what he had on his plate.

How do you run the business intelligence algorithms to create a solution?  Anyone in the financial section can verify how complicated this is and becomes, and if the desired results can’t be produced, well where do you go from there?  To what levels can one be pushed to ascertain desired results when perhaps the revenue required to do so can’t be generated?  BD  

David B. Kellermann, the Freddie Mac executive who was found dead Wednesday in what appeared to be a suicide, discussed taking time off with the company's human relations department Tuesday, according to a person familiar with the matter.
Kellermann, a longtime employee of the troubled mortgage giant who had been acting chief financial officer since a government takeover in September, told officials that he was feeling stressed and working long hours, and that he needed to take a break, the person said.

Freddie Mac assured Kellermann he could take a week off, effective immediately, and his subordinates could run the finance operation without interruption. On Tuesday night, Kellermann apparently decided to take the vacation and delegated responsibilities to two senior members of his staff, the person said.

Siemens Medical Solutions USA Inc., whose Malvern, Pa., complex was searched by Defense Department agents Wednesday, is a defendant in a whistle-blower lawsuit.

The unit of German conglomerate Siemens AG (NYSE:SI) is accused in the suit of giving corporate customers of its medical imaging equipment bigger discounts than it gave the federal government while assuring the government that it was getting the best discounts Siemens offered.

The filer, William A. Thomas, was an executive with Siemens and also worked for a company that bought equipment from it and a company it acquired.

X Prize Foundation – Bid on have your Genome Sequenced on EBay Auction

This looks like a new and different way to raise money for the X Prize Foundation.  The medical side of the foundation has recently been in the news but the genomics side of the business has been established for quite a while.  The related reading below gives some of the history.  A few months imageago, Harvard Professor Steve Pinkerton wrote about what it meant to him to have his complete genome sequenced.  Its a lot of information and how and what you do with it all is still evolving.  If you are not sure what this is all about, the link below has a video and will give you a quick run down.

Playa Vista-based X Prize Foundation is taking an unusual approach to fund its nonprofit efforts, and is auctioning off a complete gene sequencing to the highest bidder on eBay. The auction--which starts at $68,000--will give the winner a completely sequenced, readout of their genetic map. The foundation is tapping DNA sequencing firm Knome for the prize, which usually costs nearly $100,000. Full mapping of a DNA sequence is still a labor-intensive process, and usually only done as part of more extensive scientific efforts. The auction will go to help fund the foundation's efforts to accelerate personalized medicine. The auction starts Friday, and runs until May 4th.

Dr. Halamka addresses a couple good points with his presentation, as always and he is also very good with keeping up updated on his blog as well.  One topic I agree with and I think any physician does is to “maximize the ease of use”.  I had one intern tell me he had to learn 5 different systems at 5 different hospitals, so again having something somewhat uniform or familiar for the end users could really be of help. 

The privacy issues he discusses are important too, as when you look at the potential fines, they are big and basically could put a practice right out of business, again making the case for not having to set up servers and email exchanges at doctor’s offices and the fact that even with reimbursement, not many have 40k sitting around in their bank accounts for the initial set up.  The common user interface is a open source code project built by Microsoft that could offer relief with the design of user interfaces, complete with Silverlight and dynamic screens to keep the amount of clicking down a minimum and provide screens that would be either the same or very similar at all facilities.  BD

Moving the nation to electronic health records could save millions of dollars, simplify the health-care system and create as many as 50,000 new jobs, though it will be a tough journey to get there, Harvard Medical School CIO John Halamka said today.

Halamka, the keynote speaker at the sixth annual SAS Healthcare and Life Sciences Executive Conference, held Wednesday and Thursday at SAS’ headquarters in Cary, was discussing the 400 pages of federal stimulus legislation related to electronic health records and key issues facing the health-care and information technology industries.

At the same time, technology needs to be developed to maximize ease of use for physicians.

“Putting servers and exchanges into doctors offices is not going to work,” Halamka said, suggesting a better model is using regional health-care information technology centers that use cloud computing systems to work with doctors. Massachusetts, for example, will use a cloud computing center to manage the state’s electronic health records. That system should be up and running by the end of 2010.

And still to be determined is the issue of privacy. Under current federal regulations, privacy breaches that affect 500 or more patients fall under Federal Trade Commission regulations and come with fines ranging from $25,000 to $1.5 million, depending on whether the action was accidental or intentional.

On top of that, doctors not only have to notify patients of the leak, but also the prominent news source for the region.

“What is the value of doing this if there are such stringent rules and penalties?,” Halamka asked rhetorically.

People who have lost an arm have not traditionally had much hope of ever regaining meaningful function. Prosthetic arms have been controlled in a rudimentary way, by transforming residual shoulder movements or muscle signals into the ­simplest movement commands. These artificial arms cannot do two things at once, much less three or four. Amputees often toss them in the closet out of sheer frustration, somewhat stung by the fact that leg amputees have far better products available to them.

But the situation is starting to change, thanks to a team led by Todd Kuiken, director of the Rehabilitation Institute of Chicago's Center for Bionic Medicine. Kuiken has developed a novel surgical technique that, when paired with both motorized prosthetic arms already on the market and experimental bionic arms developed through a Defense Advanced Research Projects Agency (DARPA) program, affords amputees a remarkable degree of dexterity. Claudia Mitchell, who lost her arm in a motorcycle wreck in 2004, remembers putting on a prosthesis after undergoing Kuiken's procedure and seeing it work for the first time: "You could not wipe that grin off of my face. I can now iron a shirt again like nobody's business." Mitchell has become a hit at parties. "People can't believe how this thing works," she says. "They want to see me do things with it."

Republicans with a roadblock to delay Sebelius as HHS Secretary

I have my own personal reservations, but not because of what the GOP has going on here, but rather related to the understanding of Business Intelligence and the levels this position will require and having some IT knowledge rather than just the old political stuff is needed in a position that is around 70% focused in this area.  To get better healthcare, we need someone in the know in this area and not just another person who has risk management as a background, as that is what tearing up healthcare, but there are some that don’t seem to get the picture on this yet.

Again, when I watched the testimonies in the Senate earlier this year, almost hands down in the committee, nobody knew what a PHR was and I imageguess taking a few minutes out to visit the web ahead of time to just have a quick summary must have been out of the question?

So in essence, we have a question of not only her background and being qualified, but also the folks doing the voting.  Education is a huge problem in the US and it appears to have some top level implications too from what I am reading.  Can we finally put the abortion thing to rest and get on with more intelligent solutions?  The US has spent more time on that subject and opinions are not going to change and neither is the availability for women, so that topic tends to be nothing but a filibuster anymore to detract from the real issues of where we need to be. Can we please work at a country and elevate some of the “Smart People”, we are lucky and have many in the US and we need to have the right folks in the right positions.  BD

Republican lawmakers in the Senate have blocked a move to confirm Kansas Gov. Kathleen Sebelius as HHS secretary.
In a brief exchange on the Senate floor, Majority Leader Harry Reid (D-Nev.) pushed for a vote on the governor’s nomination today, but was rebuked by his Republican counterpart Mitch McConnell (R-Ky.).
McConnell said that members of his party needed more time to consider her nomination. It is not clear when a vote will take place. It is unlikely that the Senate will meet tomorrow.

The Senate Finance Committee on Tuesday voted 15-8 to move forward on Sebelius’ nomination to the nation’s top healthcare post. But Republican opposition could unsettle a tidy confirmation process.

Once again, it appears the phones have it.  Not to be outdone by the iPhone, Windows Mobile units could be doing a whole lot more in the future.  I would guess you might want to put the phone on vibrate while doing an ultra sound so as not to affect the outcome (grin). 

I don’t quite understand the biopsy function yet, but perhaps more information will follow soon.  Cell phones are ending up in places we never thought of before.  If the price is around $500.00, perhaps the wireless carrier will give a break on the price with a 2 year contract (grin).  One day we may have to start doing our own ultra sounds before arriving at the ER.  BD  

ST. LOUIS, April 22 (UPI) -- U.S. engineers say they have created a USB-based ultrasound probe technology that enables a smart phone to imagebecome a medical imaging device.

The Washington University in St. Louis scientists, led by Associate Professor William Richard and researcher David Zar, said the technology makes commercial USB ultrasound probes compatible with Microsoft Windows mobile-based smartphones. That allows the use of smartphones for imaging kidneys, liver, bladder and eyes, prostate and uterine screenings and biopsies, as well as using vascular probes for imaging veins and arteries for starting IVs and central lines.

We don't know when these might be commercially available, but they are hoping to sell them for around $500 -- significantly cheaper than many portable ultrasounds, which can cost almost $30,000.

Cigna to Offer Quicken Health Expense Tracker, United HealthCare in Beta – Easily Identify Balance Billings?

Is everyone as excited about this as I am (grin).  Perhaps it will identify the balance bills before you get them in the mail.  The software also makes itimage very easy and simple to pay them too it states.  Well at least at this point we might be assured the Ingenix data base probably won’t be used to determine the usual and customary fees. 

They do have a page on Twitter.

It may serve to help find errors, but the EOBs can help you do the same, but what I am wondering is this going to tie into the Personal Health Records the companies offer?  We saw some of that last week on the internet and again, how accurate and trusting will this tool be with working with PHRs?  With the slow growth of health information in PHRs, I just wonder how fast this will, or if it will take off.  Just as with getting an EOB if there is something wrong, an individual still has to pursue and get items corrected, but there does seem to be an emphasis on how easy it is to pay.  My own feelings is that I am very hesitant to use a PHR from a risk management company and have more trust in Microsoft and Google Health at this point, that is again if this is set to integrate with their PHRs.  BD

This is a little off base here, but it has privacy issues so here it is.  If someone in your family plan of phones wants to track you, well they have itimage now.  The trackee does get a text message too, but if Mom is after you, she can find you.  The family that tracks together stays together I think. 

I wonder how long this will stay in the family before it graduates to the next level up, like company provided cell phones, or ones used in the hospital and we are all in a family of some sort.  Just a thought.  BD

AT&T just launched FamilyMaps, a service that tracks any AT&T cellphone from another phone or PC. The trackee (your child, girlfriend, elderly parent, whoever's on your family plan) gets a text message that he or she is being watched — and in real time on a map, or by text or emails with the location, you can see where they are. A scheduled service will send you location information at a certain time each day, so you can get an email when your kid makes it to band practice. The service only works on phones within a family plan. So, there's no way your boss can track you when you call in "sick" from the baseball stadium.

The difference with the AT&T services is that it doesn't require the person being tracked to run the same application, and the others have privacy settings. With FamilyMaps, the account holder controls these settings, so you could be always trackable by your family. You've got nothing to hide. Right?

Smart Underwear is Here – Senses immobility and stimulates Muscles to Prevent Ulcers from Forming

I am guessing they are battery operated.  Actually this sounds like a real good thing for those who are in wheelchairs or bed ridden, and maybe just those who might like a little extra benefit from wearing this type of underwear.  BD 

Vivian Mushahwar, a University of Alberta cell biologist and Alberta Heritage Foundation for Medical Research senior scholar, and her imageteam have designed "smart" underwear in an effort to prevent pressure ulcers from developing on bed-ridden people or those in wheelchairs. The undergarments sense that a person's skin is under pressure because of immobility, and, in turn, stimulate muscles in those areas to circulate blood and prevent ulcers from forming.

"It would take me 20 years to get the results this team will be able to achieve in five years," said Mushahwar, a professor in the Faculty of Medicine & Dentistry and at the Centre for Neuroscience, of the collaborative nature of the project. "Our team is designing neural devices with input from the people who will use them, and from the doctors and rehabilitation specialists who know the risks, and who themselves have dreamed of creative solutions."

The artificial knee, dubbed the JaipurKnee, was developed by Joel Sadler, a lecturer in mechanical engineering and d'Arbeloff Fellow, and his team at the Hasso Plattner Institute of Design at Stanford University.

China Trusts Western Drugs over Chinese Pharmaceutical Companies

What is scary about this article is the last line, a fake batch of medicine for diabetes, something we need to worry about here too as some of the drugs we take are manufactured overseas.  We have had those scares too here in the US, but it has mostly been over the counter drugs and not prescription drugs.  We think we have advertising here in the US for pharmaceuticals, it appears it is a lot worse in China and most of the ones advertising are the companies in question.  At least here we have the legit ones pounding us every night at the 6 PM news so far.  BD 

"Nowadays, Chinese people don't trust Chinese medications. They trust Western brands more as they have a better reputation," said Huang Jianshi, Assistant President of the Chinese Academy of Medical Sciences and Peking Union Medical College.

Foreign drug companies such as GlaxoSmithKline Plc and Pfizer Inc usually work directly with hospitals and doctors and rarely advertise, explained Du Jinsong, a pharmaceutical analyst with Credit Suisse in Hong Kong.

China's State Food and Drug Administration (SFDA) counted 329,613 cases of the distribution of unlicensed drugs and medical products in 2007 and collected 746.17 million yuan (or $109 million) in fines.

But the fines have done little to deter the sale of untested drugs in a country where regulation is lacking and enforcement is lax. Analysts said it was hard to measure to what degree public mistrust of adverts have affected drug sales, which grew 26 percent to 752 billion yuan ($110 billion) last year in China.

Still, despite bans, unlicensed and untested medical products are heavily promoted on the Internet, TV and billboards, as well as in newspapers and magazines across China.

Another problem is drug piracy. Sometimes fake drugs are packaged and sold to look like the medications of reputable firms.

In one case in January, the government ordered doctors to stop prescribing a well-known diabetes drug after a fake batch of the medicine was linked to the deaths of two patients in the far western region of Xinjiang.

Three Million People Now Using Kaiser Permanente's PHR – My Health Manager

With over more than 600,000 secure e-mail messages a month this sounds like a success.  They also have the pilot program with Microsoft HeatlhVault going too, so records can go from My Health Manager to the HealthVault.  Now we need an “e-patient Dave” to report in for us (grin).  BD

Siemens Office gets searched by the Pentagon

The word is pretty quiet on what has occurred here so far.  It appears to be related to DOD contracts from what is said here.  Siemens does quite a bit with DOD and not too long ago I posted about the Ultrasound Cuff to stop internal bleeding, but this may be something totally different.  image

Over the last year there was quite a bit of unrest over in Germany too with the resignation of the CEO of healthcare, not to mention some pretty large layoffs and job cuts.  BD  

WASHINGTON, April 22 (Reuters) - Pentagon investigators searched the Pennsylvania offices of a unit of Germany's Siemens AG (SIEGn.DE) on Wednesday as part of an investigation of a Siemens contract with the U.S. military, a company spokesman said.

"Investigators from the Defense Criminal Investigative Service (DCIS) of the U.S. Defense Department today conducted a limited search of Siemens Medical Solutions USA, Inc's Malvern facility," said spokesman Lance Longwell.

"The search was in connection with an investigation of a Siemens contract with the Department of Defense," Longwell said. He did not identify which contract was in question.

Ed Bradley, DCIS special agent in charge, said the search of the Siemens facility in Malvern, a suburb of Philadelphia, began early on Wednesday and continued throughout the day. He gave no details on the nature of the investigation.

The No Insurance Club – Interview with Chad Harris, Director

A short while back I posted a press release about the No Insurance Club and this week I had an opportunity to talk with Chad Harris, Director of the imageNo Insurance Club to find out a little more about what they have to offer. You may or may not be familiar with concierge or boutique medical practices as they have been around for a few years, but for many, the price is out of range. The No Insurance Club is an affordable solution for many, as you are getting your “basic” preventive and general medical conditions taken care of by your physician at a reasonable cost, and you know what the cost is going to be up front instead of the potential of receiving a balance due bill.

In Gilbert, Arizona the concept was born from an physician, Dr. Sam Sannoufi, MD, who is also an ER physician with post cards, very simple and the concept has grown from there. It appears to be a win-win, as the patient benefits and the doctor has his money up front instead of perhaps a 2-3 month wait for the money to come from insurance companies and Medicare for example.

This almost sounds too good to be true, is the club open to anyone?

The club is open for anyone to join. Again, it is designed to take of care preventive and general physician’s office visits. With many individuals ending up unemployed with today’s economy and job cuts, this is a place where many never thought they would end up. Insurance rates are also skyrocketing and is becoming less affordable. Our focus today is with the family or general practitioner and there are plans to expand this into specialty areas as it grows. A patient with serious health issues beyond what is covered under general services would still need to consult with a physician outside of what is covered, but on the average a person makes 3.8 visits a year to the doctor, and the plan for an individual gives a person 12 visits a year. Here’s a brief breakdown on how it works:

Single Membership - $480.00

  • FREE - Office Tests and Services (may vary per location) Search Locations

Is it just the cost of an office visit that is covered only?

There are additional inexpensive labs and medications that are provided. The list below will give you a couple examples.

What does it cost for a doctor to join the plan? Is there a large administrative cost as some of what I have seen from other concierge plans take a good chunk of money for overhead?

The program is free for doctors to join. The money made from administering the plan for us is pretty minimal and as an example for a single membership of $480.00, we take $80.00 and the rest goes to the physician. Patients are enrolled in the data base and we provide a web site dashboard for physicians to log in. We are not there to supply overhead or to try to tell the physician how to run their business better, but rather an alternative to dealing with insurance companies and helping those who cannot afford insurance, take care of their health. There are no co-pays.

As you may have read in the news of late, many are not going to the doctor as they cannot afford it. The physician has the option of accepting or not accepting any patient in the plan. In many instances there are patients who used to have insurance but can’t afford the individual visits and medication costs so this again works well in making it affordable. We do suggest to patients to have a catastrophic policy to cover major events if they can afford it, as this once more is just regular and preventive health care. One other item that works well for both the physicians and patients is the ability to take care of multiple issues on one visit, unlike what is done with insurance carriers as in many instances another appointment is required to address a second or third health issue, so you have more appointments at the doctor’s office that could be covered at one time.

The website also offers a calculator for physicians to get a rough idea as to what their income could be with the No Insurance Club. Without having to schedule additional appointments time and money is saved. In addition, there’s no billing to be done as the money has already been paid up front so it can stand to take a bite out of collections expenses.

If a patient had a chronic condition outside of the areas covered here with general health care, could they still become a member?

Yes, they could still enroll and take advantage of what the program has to offer, but again with health care areas outside of what we cover, visits to specialists, or a medical emergency is not in the program, and again any physician can opt out with any patient with the plan. If this does occur, there is a one time no-charge allowance for this. This is again covered by the annual agreement, so if a 2nd change within the year is made, there’s an administrative fee for a 2nd change within the one year cycle.

One other item to think about is that current physicians might want to offer this to existing patients, as chances are there’s already a patient-physician relationship established and for those having trouble paying cash for their visits, let’s say due to losing a job, this again could be the win-win solution for both. The website, once a physician is enrolled also has a listing of patients in their local area.

Is this only a “retail” solution for individuals to join the club on their own? What if I worked for a company who could only provide catastrophic coverage and I wanted to get a plan like this to work for me?

Yes there’s nothing stopping an individual from joining the club on their own, however, we do have another area of focus for businesses too. If a large enough group through an employer were to enroll, monthly payroll deductions would be allowed for employees for their cost. Businesses today are the driving force behind insurance and healthcare and we have even seen in the news, companies like Cisco that have their own on-premise doctor’s offices, but for the small to medium employer this is not a cost effective option and this is where we can help out. Employers all over are unhappy with the ever growing cost of health insurance contracts and the stipulations involved to participate are growing in order to secure a lower rate on the contract.

Some day you could even see businesses perhaps purchasing hospitals! We believe what we have to offer is also another win-win situation, and it is involving the doctor in the employee’s healthcare at the relationship level, without 3rd parties also getting involved in order for the employee to have some basic healthcare options.

What if a patient required more than 12 visits in a year, let’s say, would they be disqualified from participa

tion? It may sound like a bit of an odd question, but how would the No Insurance Club handle this?

Again as mentioned, this is completely up to the individual doctor’s office and there are additional plans to cover this if needed. We are not there to run their business for them, but merely help with the affordability and practical side of general healthcare. Again, the average is less than 4 visits a year, so based on that business model, the averages should work out.

How do I gather all the information I need if I don’t see it on the website?

We have a live chat on the website and also have a toll free number for both patients and physicians to call. In addition, we post additional new developments on our blog. The video included is a patient discussing how the plan has worked for him as he suffers from diabetes.

Bumrungrad International Hospital to Go Wireless With Windows Mobile to run Microsoft Amalga

A while back I had the pleasure of speaking with Steve Shihadeh, vice president, Microsoft Health Solutions Group and we talked about the varied imagesolutions of Amalga.  Outside the US, many places are starting from the ground up with limited or no data systems in place and the hospital in Bumrungrad is one example.  The link below has a couple videos that describe more about the hospital and their Amalga solution.

In addition to accessing the medical record son the MC50 phones, they will also be equipped with bar code readers as well for medication and patient identification.  BD  

Bumrungrad International Hospital plans to install a wireless system including Motorola handheld devices at its facilities to allow doctors and nurses to access electronic medical records.

The wireless system will fill a gap at the hospital as it works to install computers in every patient room. The computer project will take three years to complete, yet administrators want health professionals to be able to take advantage of digital data at the hospital anytime, anywhere.

imageBumrungrad is famous as a place for vacationers in Asia to stop in for anything from a check up to major surgery. The electronic medical record system it developed with software maker Global Care Solutions was bought by Microsoft and is now being sold throughout Asia as the Amalga HIS system.

The MC50 uses Microsoft's Windows Mobile OS and will be able to run the Amalga HIS software already in use at Bumrungrad later this year so that electronic medical records can be accessed on the handhelds.

Is This a Case for a New Law – Illegal Algorithms? How Do You Sleep at Night Rockefeller asked the CEO of United Health Care

The Ingenix Inquisition continues with efforts to find out if federal employees were also potential victims.  We have laws for almost everything else you can think of out there, and algorithms determine about 95% of all business decisions today.  Come to think of it, how about the algorithms that were run by Wall Street?

This could also open doors for prosecuting those who write and send out malicious code on the web too.  If an algorithm is imagedetermined to be creating a source of money that is not legal, it could be considered an illegal algorithm.  With the growth of business intelligence today, this could be something to think about, but Congress would need help from the likes of Microsoft and Google to get the wording correct.  This would also lead the way to having some experts in the judicial system as well in this area.  Intellectual property has really not come under any real scrutiny or enforcement areas of the law and yet, formulas or algorithms are created all the time that unfairly cheat or are illegally used for the sake of driving revenue or stealing, which ever the case is.  Patent offices of course are there to check and protect the legitimate software vendors and with open source software problems are not hidden with a huge assortment of users, but it’s some of those “other” items floating around out there that are strictly there for analytical and revenue generating purposes that integrate with other systems that might be in question.  These too were some of the areas both misunderstood or not addressed by the SEC as well with the Madoff case.

Audit functions would be the tools used to determine if a business algorithm is functioning properly and fair I would guess.  Anyway, just some rambling thoughts here on a couple ideas I had this evening.  The Texas Medical Association and Legislature have begun work on a similar type of penal code as relates to physicians and creating some fraud statutes. 

With the age of transparency on us, all the deep buried algorithms that may have been either somewhat proprietary or hidden are now becoming visible.  This is not a case for every program to be scrutinized, but rather those that are more or less financially based to be legally constructed. 

In this case of the data base being used, from what has been in the press it appears that the formulas used were not accurate and perhaps not legal, in other words the SQL statements that produced the “desired” results. “Desired” results should be within the limit of the law, just as a contract that was illegally written would be scrutinized as well to determine whether or not it was correctly executed and signed.  BD

U.S. Sen. Jay Rockefeller (D, W.Va.) has asked the Inspector General of the Office of Personnel Management to investigate whether federal employees were overcharged for health care because their plans use a database operated by UnitedHealth Group subsidiary Ingenix.

"I am concerned that federal employees participating in the Federal Employees Health Benefits Program may have been charged excessive out-of-pocket costs because of the health plans' use of the Ingenix database products to determine rates for out-of-network services," Rockefeller wrote in a note dated March 31.  Rockefeller wrote that he wants to know, going back 10 years, how many FEHB plans used Ingenix to set rates and how many federal employees were affected.

Rockefeller was unconvinced. "I don't know, frankly, how you sleep at night," he told Slavitt and United President and CEO Stephen Hemsley.
